Consumer Protection
Despite the existence of consumer protection agencies, there are still many instances where consumers are harmed by unsafe or unfair business practices. These cases may involve physical injuries from defective products or financial injuries from corporate misconduct.
If you or a family member has been harmed by:
or any other situations where you have been taken advantage of or harmed as a consumer, we can help.
One
example of a consumer fraud case we handled involves National
Medical Enterprises (NME), a health care company that operated
psychiatric care facilities. It was alleged that NME
paid individuals to recruit patients for admission to the
facility. It was alleged that If NME found out that
a person had insurance coverage and were in any kind of
distress, they would admit the patient to their psychiatric
care facility. It was alleged that the patient’s
length of stay was predicated on how many days insurance
would pay, without regard to the patient’s needs,
condition or appropriateness of confinement. If the patient
had 20 days of insurance coverage, the stay was 20 days.
James Esparza represented 30 individuals in the NME litigation
in Third District Court, State of Utah, successfully resolving
everyone’s claim against NME after lengthy litigation.
If you have been the victim of unfair, unlawful, deceptive,
fraudulent or bad faith business practices, filing a lawsuit
can not only help you to recover your own losses and damages,
but may help stop the unscrupulous perpetrator and help
protect other consumers.
